Terms of Service

§1 General Provisions

The online store available at www.toothead.com is operated by LUDOJADY sp. z o.o., based at ul. Puławska 12/3, 02-566 Warsaw, Poland. NIP: 5213887225 REGON: 385313114 KRS: 0000823176.

1. These Terms govern the use of the online store, order placement, product delivery, payment, withdrawal from the contract, and the complaint procedure.
2. The Seller can be contacted via email: hello@toothead.com (responses provided within 48 hours on business days) and by phone at +48 535 857 990 (charged according to the operator's rates) on business days from 10:00 to 17:00. A contact form is also available in the store.

§2 Definitions

Consumer – a consumer as defined by the Civil Code.
Buyer – any entity making a purchase in the Store.
Seller – LUDOJADY sp. z o.o., ul. Puławska 12/3, 02-566 Warsaw, Poland.
Store – the online store operating at www.toothead.com.
Terms – these terms and conditions.

§3 Order Placement

1. The Buyer can place orders 24/7 through www.toothead.com.
2. To place an order, the Buyer must:
  • Select a product and add it to the cart;
  • Fill out the order form;
  • Choose a delivery and payment method;
  • Accept the Terms;
  • Confirm the order ("Order with obligation to pay").

3. Order confirmation is sent by email.

§4 Payment and Delivery

1. Prices are shown in PLN and include VAT. Prices may also be displayed in other currencies depending on the store version used.

  • 6. Cash on delivery (if available)

4. Delivery is available in Poland (or other indicated regions) via courier, parcel lockers, or the Polish Post.
5. Orders are prepared for dispatch within 24 hours of payment confirmation and shipped on business days. In case of delays, the Seller will notify the Buyer via email.
6. Estimated delivery time:

  • Poland: 1–3 business days
  • EU: 3–7 business days
  • Rest of the world: 7–21 business days

7.Shipping cost is calculated automatically at checkout based on the delivery address and method.
8. International orders must be prepaid.
9. Buyers outside the EU may be required to pay local taxes and customs duties, which are not included in the product price or shipping cost.
10. In case of uncollected shipments or incorrect address, the Buyer bears the cost of reshipping.
11. The Seller reserves the right to refuse orders to countries affected by international sanctions, war, or severe logistical challenges.

§5 Withdrawal from the Contract

1. If goods are shipped to the EU, the Buyer has 14 days to withdraw from the contract without giving any reason.
2. To qualify for a return, the product must be unused, in original condition with tags and packaging, and accompanied by a receipt or proof of purchase.
Returns are processed within 7–14 business days.
3. The Seller will refund the product price and original delivery cost. Refunds are issued within 7 business days to the original payment method or a specified account in the case of cash on delivery.
4. To initiate a return, the Buyer must email hello@toothead.com clearly indicating the intention to return. The message should include:

  • Full name
  • Email used for purchase
  • Purchase date
  • Product name
  • Order number
  • Proof of purchase (photo or scan)

6. Return shipping is at the Buyer's expense.
7. After receiving and inspecting the return, the Seller will confirm acceptance or rejection via email. If accepted, a refund will be processed within 10 business days. Note that banks or credit card companies may require additional time.
If over 15 business days pass since approval and no refund is received, contact hello@toothead.com.

§6 Complaints

1. The Seller is liable for product conformity in accordance with the Polish Consumer Rights Act of May 30, 2014.
2. All products come with a manufacturer's warranty.
3. If a product is incomplete or damaged, the Buyer should contact customer support at hello@toothead.com and provide:

  • Full name
  • Purchase email
  • Purchase date
  • Product name
  • Order number
  • Complaint description (list missing/damaged parts)
  • Shipping address or parcel locker (or state "No shipping" if not needed)

4. To expedite the process, attach a photo of the defect and proof of purchase.
5. Complaints are reviewed within 7–14 business days.

§7 Personal Data Protection
The controller of the personal data provided by the Buyer while using the Store is the Seller.

Details regarding the rules for processing personal data, including purposes, legal bases, retention periods, and data recipients, are described in the Privacy Policy available in the Store. This document has been prepared in accordance with the principle of transparency defined in Regulation (EU) 2016/679 of the European Parliament and of the Council (“GDPR”).

The Buyer’s personal data, provided when placing an order, is processed for the purpose of fulfilling the order and handling sales. The legal bases for data processing are:
1. the conclusion and performance of a sales contract or actions taken to enter into such a contract (Article 6(1)(b) GDPR),
2. the Seller’s legal obligations, particularly those arising from tax and accounting regulations (Article 6(1)(c) GDPR),
3. the Seller’s legitimate interest in protecting against claims or pursuing potential claims (Article 6(1)(f) GDPR).

Providing personal data by the Buyer is voluntary but necessary to place an order. Failure to provide the data will prevent the conclusion of the contract and order fulfillment.

Personal data will be stored until:
1. the contract is fully performed and expires,
2. the Seller’s legal obligation to retain the data expires,
3. any claims related to the contract become time-barred,
4. an objection to data processing is upheld – if the processing was based on the Seller’s legitimate interest – depending on whichever of these events occurs latest.

The Buyer has the following rights:
1. to access their data,
2. to rectify the data,
3. to delete the data (right to be forgotten),
4. to restrict processing,
5. to transfer the data to another controller,
6. to object to the processing of data, if the processing is based on the Seller’s legitimate interest (Article 6(1)(f) GDPR), due to the Buyer’s particular situation.

To exercise these rights, the Buyer may contact the Seller using the contact details provided in §2 of these Terms and Conditions.

The Buyer also has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that their personal data is being processed in violation of applicable law.

§8 Disclaimers
1. When using the Store, the Buyer is obliged to refrain from any activity that could negatively affect the proper functioning of the Store, in particular from any interference with the content of the Store or its technical elements.
2. In the event of a dispute with the Buyer, the competent court will be the court having jurisdiction over the Seller’s registered office.

§9 Final Provisions
1. The Terms and Conditions are available on the Store’s website.
2. The Seller reserves the right to make changes to the Terms and Conditions, which become effective upon their publication.
3. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and the GDPR.
